A local lawmaker who represents much of the Levittown area in the state legislature will be back in court in August after being arrested on DUI charges at a McDonald’s near Harrisburg,

State Rep. John Galloway, (D-140) waived his right to a preliminary hearing on June 6.

In May police in Swatara,  Pennsylvania  which is outside of Harrisburg  were dispatched to a McDonald’s, where Galloway had struck another vehicle in the drive-through,  court documents show.

He was released on $1,000 bail and his case was transferred to the Court of Common Pleas on June 6, according to Dauphin County court records. It’s was Galloway’s second DUI arrest in the Harrisburg area.  He was arrested for the same offense in 2011.

Galloway took office in 2006  was re-elected without opposition last year. although support for the State Representative locally could be waning as one key local democrat said last month, “its time John focus on his health and getting better.”

Galloway said he would seek treatment for alcohol use in a statement he released after the May arrest

“I recognize that I have a problem. I should have recognized the problem the first time,” he said in the prepared statement. “I will seek treatment and will enter a rehab program as soon as possible. There are no excuses here. I apologize to my family and friends and to everyone in Bucks County who I am honored to represent. I will accept the consequences.”

The sentencing guidelines in the state of Pennsylvania for a second DUI conviction, are tiered based on upon the results of blood alcohol testing. Galloway could potentially have his license suspended for a year, pay fines, and or serve jail time.

Gallloway is scheduled to be formally arraigned  on August 8  in front of The Honorable Richard A.
Lewis at 9 a.m. in the Dauphin County Court of Pleas.
