Different states have different laws when it comes to Marijuana. In Pennsylvania, it is still illegal. with out a medical card.  Some people are not smoking pot, but taking candy with THC inside of the candies. This is the active ingredient that makes  marijuana illegal..

In the middle of September Bensalem Police stopped a vehicle for suspected DUI.  As the officer got closer, he could smell the stench of marijuana  permeating from the vehicle,  and that entitled the officer to look a bit farther. The officer found  several packages of candies that were mimicking  regular candy like NERDS.  The candy was illegal in PA because it had the THC ingredient.

“I just want people to become aware of what is out there. Especially this time of year with Halloween close by. Parents should look close at the wrapping paper the candy is packaged in,” said Fred Harran, Director of Public Safety for Bensalem Twp.

The driver will be charged via a citation. The affidavit of probable cause has not been filed. “We are waiting on a lab report before we file charges, ” Harran said. The charge would be a misdemeanor. The person arrested said the candy was legal in California  where he bought it,  according to Harran.  “I  have no idea whats legal in California,  but here it is not”, he said. When asked if people could buy it through the mail.  Harran said “I guess, if you can buy Vicodin  through the mail which is illegal, you could buy this, but it’s illegal.”. . .
